SEPA Issues Consultation on the New Integrated Authorisation Framework
On the 18th of January, SEPA issued a consultation regarding the new integrated authorisation framework. This consultation is closely related to the ongoing and active consultation the details of which were previously distributed via email before Christmas (21st Dec). While the earlier consultation focuses on the regulations bringing waste activities (WML and PPC) into the new authorisation regime, this second SEPA consultation addresses SEPA’s approach to implementing these new regulations.
A significant aspect of this consultation involves proposing the type of authorisation (under the new framework) that SEPA will apply to specific types of waste activities and providing an explanation for the choices made. According to the proposed system, regulated activities will fall under a new authorisation framework categorised as permit, registration, notification, or General Binding Rules, depending on the activity’s level of risk. Most waste activities are likely to fall within the upper levels of permit and registration. The consultation period concludes on the 12th of April 2024.
This is in addition to the SEPA Waste Permitting Review already issued just prior to Christmas. This revision aims to consolidate the permissioning arrangements for the four primary regulatory regimes overseen by the Scottish Environment Protection Agency (SEPA): water, waste, radioactive substances, and Pollution Prevention and Control. The consultation period concludes on 31st March.
Consultation on the Application Fees Associated with the New Authorisation.
Later in 2024, SEPA will conduct a separate consultation on the application and subsistence fees associated with the new authorisation. This consultation will also cover the standard conditions applicable to authorisation within the registration level.
